Where sourced, or drawn and manually digitized by us. We own intellectual rights to all finised machine embroidery Designs. Some of our art and illustrations come from the public domain. You are free to use these designs on finished products for small bussines productions, unless otherwise stated in the product description.
By accessing this website and downloading or purchasing any of our Designs, you agree to be bound by the following terms of our Licensing and Use Policy.
LICENSE TO USE OUR DESIGNS
When you download and/or purchase a Design, the Design remains the property of Digital Stitch Empire. For machine embroidery Designs, you are purchasing a lifetime license to embroider the Design in a embroidery machine. The license allows YOU—and only YOU—to use the Design in a variety of ways, including:

Personal use for machine embroidery,

Use on products made in an embroidery machine that you offer for sale at craft shows, craft fairs or through personal or peer-to-peer e-commerce websites;

Use on products you donate to charity;

Use on products you give as gifts.
You are allowed to edit the Design in any manner that you choose, but Digital Stitch Empire will own the copyright in the edited design file. The edited design file cannot be distributed, shared or sold and is subject to the same restrictions as our original Designs.
If you are a business or organization purchasing our Designs, you need to purchase one copy of the Design for each person who uses the Design.
PROHIBITED USES OF OUR DESIGNS AND
OTHER COPYRIGHT PROTECTED PROPERTY
You may not use our Designs or other copyright protected property for any purpose other than as specified above without our express written consent. The license prohibits selling, sharing, trading, or distributing our digital Design files. Please do not share the Design files. If your coworker, friend, or family member wants one of our Designs, please have him/her come to our site to buy a license for the Design.
In addition, we own the copyright for the photos and other images posted on this site. Please do not use our photographs or other images for any purpose. Tutorials and instructional guides, are for your individual use only. Please do not republish or distribute them in any way without our express written permission. You may sell items that you have made following our tutorials and in compliance with the design uses listed above.
The following uses of our Designs, photographs, and other images, among others, are prohibited:

Selling, sharing, gifting, transferring, distributing, passing down as inheritance, or re-selling in any manner the Design files;

Using our Designs in any media other than machine embroidery. For example, this means that you may not use our Designs for any of the following:

to create a vector file for cutting machines

for screen printing

as a template for glass etching

Using our Designs on a "machine for hire" or in any other place that would allow anyone else to access our Designs;

Using our Designs for mass production or factory production of products for wholesale or mass retail sale;

Using our designs as a basis or template for creating your own artwork;

Licensing products which you created with our Designs for wholesale or mass retail sale; and

Implying or claiming that you are the author of the artwork in our Designs.
Please note:copying embroidery designs or sharing them is a copyright violation and consequently is illegal. This is irrespective of whether you purchase the design or download a sample. You merely have a license to use the design in accordance with Our terms of use policy.
If you are interested in using our Designs to manufacture products for wholesale or mass retail sale purposes, please contact us, and we would be happy to discuss this possibility with you.
In the event that we become aware of any use of our Designs that violates the Terms Of Use Policy, your license will be immediately terminated, and you will be contacted by us or our legal representative.

STITCHING ISSUES WITH OUR DESIGNS
All designs are tested for quality prior to release. If you are having stitching issues, please email us for support using our Contact form, or send us an email at support@digitalstichempire.com and we will be happy to assist you. Digital Stitch Empire is NOT liable for items that may be damaged during a stitch out. If you are stitching onto an expensive item it is highly recommended that you do a test stitch-out PRIOR to your main embroidery as results may vary depending on your fabric, stabilizing, hooping etc. Please contact us if you have any issues PRIOR to stitching on a purchased item. We do NOT provide reimbursement or compensation for damaged embroidery blanks including clothing, bags, towels etc. It is a common embroidery practice to do a test BEFORE stitching onto a purchased item.
EMBROIDERY EDITING SOFTWARE
Our designs are manually digitized for efficiency, stitch count, and sequence. ALL designs are tested prior to availability, and quality is guaranteed in the files and sizes that we provide.
We are UNABLE to guarantee a design that has been resized, edited. merged, or opened in software that may alter the settings of the design (i.e. software programs that color sort or change the Stitch sequence by default, remove overlaps, etc.) If embroidery editing software is used to open, edit, and export a design, it is important that you are proficient with the software. We are unable to provide support should a problem arise due to too many variables in all of the software programs.
REFUNDS AND EXCHANGES
Due to the digital nature of our designs and their ability to be downloaded instantly, refunds and exchanges are not offered. We have a firm policy on this. If you have difficulty downloading your designs, please send us an email and we will assist you promptly. If you do not hear back from us within 24 hours, please re-send. DISCLAIMER
The images you see here on our site, are product mockups that we created using canva, a tool that helps us create stunning product images. These mockups are not the actual product, but they show you exactly what you’re going to get. We use product mockups to showcase our designs on diffrent products, and add transparency and professionalism to our ads. Please note that the actual product may vary slightly from the mockup due to machine setting, thread type and technique used. YOUR ACCOUNT
You may not share your login to our website with another individual. As a convenience to our customers, we have provided a venue for you to view all previous purchases. Please do not share your login or password with anyone. All downloads are tracked and monitored on a regular basis. If we find designs being downloaded to multiple computers of one account holder, downloading abilities will be suspended without notice and further rights to future downloads will be revoked.
It is highly recommended that you download your designs upon purchase. While we do provide unlimited downloads, please remember that we are selling digital machine embroidery designs and NOT a cloud storage service. Our unlimited downloads are for your convenience only and Digital Stitch Empire reserves the right to change this policy at any time. Digital Stitch Empire is NOT responsible for lost designs if you have not downloaded them.
